Terms of Service (Yamete)These Terms of Service (hereinafter referred to as "these Terms") define the conditions for using the smartphone application "Yamete" (hereinafter referred to as "the App") provided by AKASYAAPPS / アカシャアップス (hereinafter referred to as "the Company"). Users of the App and the users of devices managed by them (hereinafter collectively referred to as "Users") shall use the App in accordance with these Terms. By starting to use the App, Users are deemed to have agreed to all the provisions of these Terms.Section 1 (Applicability and Purpose)
- These Terms shall apply to all relationships between the Company and Users regarding the use of the App.
- The App is an administrative tool intended for parents or authorized guardians to restrict the nighttime use of smart devices by children under their care, support healthy lifestyle habits, and perform remote volume control, secure messaging via Family Chat, and confirm situational safety via GPS location data tracking.
Section 2 (Account Registration and Verification)
- To use the App, Users must register a valid email address and undergo identity verification via a 6-digit One-Time Password (OTP) issued by the Company.
- The management of the registered email address, active chat history linkages, and the "Master PIN" configured within the App shall be the sole responsibility of the User.
- Under no circumstances shall Users transfer, lend, or share their Master PIN or registered account with any third party (including children subject to management). The Company assumes no liability for damages resulting from inadequate credential management.
Section 3 (Operational Environment & Permissions)
- In order for the App’s automatic nighttime restriction (Silent Nighttime Interception Engine), "Remote Volume Control," "Family Chat communication delivery," and "Family GPS Location Tracking" features to operate normally, Users must appropriately grant and configure system-level permissions specified by the Company (Location Access ["Always Allow"], Audio Control, Notification Deliveries, Screen Time API / Accessibility Services, Configuration Profiles, etc.).
- Users acknowledge in advance that if system permissions are disabled by the User, or due to OS updates, device state modifications, or network/communication constraints (cellular data failure, local Wi-Fi drops, GPS satellite reception blocking, or temporary server disconnections), the functions of the App may become partially or completely unavailable.
Section 4 (Prohibited Matters)Users shall not engage in any of the following acts when using the App:
- Infringing upon the intellectual property rights, privacy rights, or other legal rights of the Company or third parties.
- Reverse engineering, decompiling, disassembling, or altering/analyzing the source code of the App.
- Placing an excessive load on the Company’s encryption servers, database storage cores, or cloud sync infrastructure, or otherwise disrupting network systems.
- Utilizing the "Family Chat" feature to transmit, store, or share text content, images, or media that are illegal, defamatory, abusive, harmful to minors, contrary to public order, or infringe upon third-party copyrights or privacy parameters.
- Installing the App without authorization on the device of a third party over whom the User has no parental or legal administrative authority, or tracking locations, monitoring, or controlling adult devices without explicit legal consent.
- Any other acts deemed inappropriate by the Company.
Section 5 (Fees and Subscriptions)
- The Company may provide certain functions of the App for free or as a paid service subject to prescribed fees (subscriptions, etc.).
- Billing, payment collections, and cancellation cycles for premium tiers are processed entirely through the platform payment infrastructures operated by Apple Inc. (App Store) or Google LLC (Google Play Store).
- If a User wishes to cancel a subscription (stop automatic renewal), they must perform the procedure themselves through their respective App Store account settings or Google Play subscription management console. Simply uninstalling the application will not halt automated billing cycles. The Company cannot issue direct financial refunds.
Section 6 (Suspension, Modification, and Termination of Service)The Company reserves the right to suspend, modify, or terminate the provision of all or part of the App without prior notice to Users if any of the following reasons occur:
- Conducting routine or emergency maintenance, database indexing, infrastructure optimizations, or system updates on the App's servers or communication nodes.
- Provision of the App becomes difficult due to force majeure, including natural disasters, communication line failures, or blackouts.
- Ongoing technical maintenance becomes impossible due to structural updates to Apple's or Google's developer agreements or core operating system (iOS / Android) engineering specifications.
Section 7 (Disclaimer & Limitation of Liability)
- The Company makes no warranties, express or implied, that the App will fit a User's specific purpose, possess the expected capability, restrictive efficacy, or location tracking accuracy, or operate completely free of system errors.
- Due to the technological nature of mobile operating systems and cloud communications, the App's nighttime restrictions, remote audio controls, real-time location tracking features, or Family Chat real-time message relays may temporarily fail to execute, experience delivery lag, or display inaccurate coordinates due to device shutdowns, depleted batteries, Airplane Mode activation, forced OS reboots, obstruction of cellular/GPS signals (underground or high-density building areas), or native platform framework bugs. The Company shall not be liable for any unauthorized device usage, lost children, data transmission delays, accidents, or liabilities resulting from such technical or infrastructure failures.
- Even if this disclaimer is limited by the Japan Consumer Contract Act or other mandatory statutes, the Company's liability for damages to a User shall be limited to direct and ordinary damages arising from the Company's breach of contract or tort, capped at the total amount paid by the User to the App during the 3 months immediately preceding the event that caused the damage.
Section 8 (Governing Law and Jurisdiction)
- These Terms shall be governed by and construed in accordance with the laws of Japan.
- Any disputes arising between the Company and Users regarding the App or these Terms shall be subject to the exclusive primary jurisdiction of the district court having jurisdiction over the location of the Company's head office.
